Terms of service
The rules for using Pencil: what you can expect from us, and what we ask of you. Written to be read, not skimmed past.
01Using Pencil
Pencil is a workspace for pages, and it’s in beta.
Agreeing. By creating an account or using Pencil you agree to these terms. If you use Pencil for an organisation, you confirm you can accept them on its behalf.
Beta. Pencil is in beta. Features can change, break or go away, and we may add or change limits, such as the daily AI limit. We’ll tell you about big changes in Pencil.
Age. You need to be old enough to agree to these terms where you live. If you’re under 16, ask a parent or guardian first.
02Your account
Keep your sign-in safe. You’re responsible for what happens in your account.
Signing in. Sign-in is handled by Clerk. Give us accurate details and keep your sign-in secure. Tell us if you think someone else has got into your account.
Your activity. You’re responsible for what happens in your account, including pages you share and people you invite to them.
03Your content
What you write stays yours. You let us run Pencil with it.
It’s yours. Pages, templates, files and everything else you put in Pencil stay yours. We don’t claim any ownership of them.
What you let us do. You let us store, display and process your content only as far as needed to run Pencil for you: saving and syncing it, showing it to the people you choose to share it with, and answering the requests you make to Pencil AI.
Your responsibility. You’re responsible for what you put in Pencil, and for having the right to use it. Don’t add other people’s personal data unless you have good reason to.
04Public pages and sharing
Private by default. What you make public, anyone with the link can read.
Public pages. A page you switch to Public can be read by anyone with the link, and by search engines if you also allow that. You’re responsible for it, and for making it private again if you change your mind.
Shared templates. A template you share to Community is listed in Pencil’s public template gallery, and anyone signed in can start a page from it. Share only what you’re happy for others to copy.
Other people on your pages. People you invite as editors can change the page, and what they add is their responsibility as well as yours.
05Pencil AI
Helpful, not always right. Check it before you rely on it.
It can be wrong. AI answers can be wrong, out of date or incomplete. Read what Pencil AI writes before you use it, and don’t rely on it for medical, legal or financial decisions.
You’re in control. Nothing the AI writes is added to a page until you choose to insert it, and you can undo changes it makes.
What’s sent. Requests are processed by the AI providers described in the privacy policy, so don’t put in anything you aren’t comfortable sending to them. AI use is limited per account each day.
06What you can’t do
No unlawful content, no attacks on Pencil, no working around limits.
Content. Don’t use Pencil to store or share anything unlawful, anything that infringes someone else’s rights, or anything meant to harass, deceive or harm others.
The service. Don’t try to break, overload or probe Pencil or other people’s accounts, scrape it at scale, or work around its limits (such as the AI limit).
What we may do. If these rules are broken we may remove content or suspend an account, and we’ll tell you why when we can.
07Availability
We try to keep Pencil running, but can’t promise it always will.
We work to keep Pencil available and you can see how it’s doing on the Status page. We can’t promise it will always run without interruption or errors, especially while it’s in beta.
Keep a copy of anything you can’t afford to lose.
08Ending your account
You can leave whenever you like. We can end accounts that break these terms.
You. You can stop using Pencil at any time and ask us to delete your account. What happens to your data is in the privacy policy.
Us. We may suspend or end an account that breaks these terms or puts others or Pencil at risk. Where we can, we’ll tell you first and give you the chance to take your pages with you.
09Liability
Pencil is offered as it is. Your legal rights stay as they are.
As is. While Pencil is in beta it’s offered as it is, without promises beyond those the law requires. As far as the law allows, we’re not liable for lost data, lost profit or other indirect losses.
Your rights. Nothing in these terms limits rights you can’t give up, or liability the law doesn’t allow us to limit, such as for intent, gross negligence, or death or personal injury.
Consumers in the EU/EEA. If you use Pencil as a consumer in the EU or EEA, the mandatory consumer protection rules of the country where you live still apply, and nothing here takes them away.
10Changes and contact
We’ll tell you before anything important changes.
If we make significant changes to these terms, we will let you know in Pencil before they take effect. The date at the top shows when they were last updated. Using Pencil after a change means you accept it.
Read the Privacy policy to see what we do with your data. Questions about these terms? Use the contact page.
